Terms and Conditions

LIABILITY DISCLAIMER AND INDEMNITY  

1. I agree and understand that the Mountain Festival Adventures events (“the Event”) is an extreme adventure sport and risk of serious or  permanent injury, illness, disability including death and/or damage to sporting and other equipment is inherent in  the nature of the Event. I have fully acquainted myself with the possible risks of participating in such extreme sport.  I acknowledge that the risks include but are not restricted to risks arising from my skill or ability as runner, my nutrition  and fluid intake, my fitness and health prior to the Event, the weather conditions during and before the Event,  vehicular traffic during transportation, actions of other participants, spectators, Event organizers, sponsors, property  owners, their agents, servants and assigns. I accept all the risks and confirm that I am participating at my own, sole  and absolute risk and costs, without any force, duress or inducement from any person. 

2. I agree and undertake to take all due care and caution while participating in the Event and will be solely responsible  for any loss or liability suffered by me or any other person or property, including other participants due to my rash or  negligent acts or omissions or lack of care, caution or diligence. 

3. I agree to indemnify and keep indemnified and hold harmless the Event organizers, sponsors, property owners, their  agents, servants and assigns against all and any claims of whatsoever nature or howsoever caused arising out of my  participation in the Event, including loss, damage or liability or claim for consequential loss, damage or liability to any  person arising directly or indirectly out of my act or omission. 

4. I agree and understand that the Event Organizers, sponsors, property owners, their agents, servants and assigns will  not be responsible for any claim whatsoever arising out of my death, injury, disability, illness or loss and/or damage to any person or property occasioned as a result of my participation in the Event or damage to/ theft of my property  by any person. 

5. I declare that I am physically and physiologically fit to participate in the BMF ULTRA (“the Event”). I have been  examined by a qualified medical doctor and I have not been advised against participating in the Event. I undertake  that I will withdraw from the Event if I am so advised by the Event organizers or medical attendant on account of my  condition or my participation in the Event could expose my or any other participant’s health or life or equipment, to  risk. 

6. I understand that only basic first aid will be available to the participants at the Event venue and in case I require  additional medical attention/care I consent to receive such medical treatment as may be advised and I would be  solely responsible for all costs and consequences thereof, including costs of medical treatment, hospitalization,  transportation, etc. 

7. I agree and undertake to abide by all the rules of the Event and follow all directions/ instructions given to me by the  Event organizers, their agents, servants and assigns; and in the event I do not I may be restrained by the Event  organizers, their agents, servants and assigns from continuing my participation in the Event. 

8. I give my consent to be photographed and/or filmed before, during and after the Event and the Event Organizers may  use, display and promote my pictures or video and my name for any legitimate purposes for the Event or future  events, including publicity by whatever media of the Event, Event Organizers, sponsors, property owners, without the  need for my permission or payment of any fee/consideration to me. 

9. I agree that my entrance fee is non refundable. I understand and consent that the Event Organizers may, entirely at  their discretion, cancel or postpone the Event due to any changed circumstances, including bad weather or situations  not conducive for safely or effectively conducting the Event.  

I confirm and declare that I have fully understood the meaning and import of this liability disclaimer, waiver of claims and  indemnity and by affixing my signature I am waiving all my legal rights (for myself and on behalf of my dependants) to give full  effect to the meaning and import of this document
